These Terms and Conditions govern your use of the Vote.Com site. Please read these terms and conditions carefully before using this site. If you use this site (whether passively reviewing its content, or actively participating in votes, message boards, chats or other content), you indicate your acceptance to these terms and conditions. If you do not agree to these terms and conditions, please do not use this site.
These Terms and Conditions are subject to change without prior notice, and your continued use of this site constitutes acceptance of any changes to these terms and conditions. Accordingly, please check back periodically for any changes. The same applies with respect to use of the company's privacy policy, and with respect to any changes in this privacy policy.

The materials on this site provided by Vote.com (including editorial and other written content, images, audio and video clips, and code and software) are owned by Vote.com and are protected by international copyright and trademark laws. You may not use, reproduce, publish, transmit, publicly perform or display, translate, create derivitive works from, or otherwise communicate to the public the content thereof, in whole or in part, any material from this site, except that you may make one copy, for your personal, non-commercial use only, provided that all copyright and other notices are left intact. Any other use of this material (including any modification of this material) is prohibited.
The mark "vote.com" is a trademark and a service mark of Vote.com, Inc. (registration pending), and may not be used without permission.
By submitting any content to the Vote.com site, including by posting messages, participating in chat, participating in votes or other surveys, inputting or uploading data or engaging in any other form of communication on the site (any such content submitted by a user being a "Member Submission"), you are granting to Vote.com and its affiliates a royalty-free, perpetual, irrevocable, unrestricted, non-exclusive right and license to use, reproduce, publish, transmit, publicly perform or display, translate, create derivitive works from, or otherwise communicate to the public the content thereof, in whole or in part, on a world wide basis, including the right to incorporate it in other works in any form or media whatsoever. You also grant to Vote.com the right to sublicense any such Member Submission to third parties, and to otherwise exploit any proprietary rights in such communication including copyright, trade and service mark, and patent laws.
Vote.com is not responsible for the content of any Member Submission. If you believe that any Member Submission or other Vote.com content violates a copyright that you own, please follow the Notice and Procedure for Making Claims of Copyright Infringement.
Privacy
Vote.com is dedicated to protecting the privacy rights of its users. Under no circumstances will Vote.com collect any information that is identifiable to any individual site user. See privacy policy for the details of Vote.com's privacy policy.
User Conduct
Vote.com does not control the information submitted by users of the site to its bulletin boards, chat rooms and other user generated pages, nor does it undertake to monitor or review such Member Submissions. Vote.com is not responsible in any manner for Member Submissions, and any opinions, advice, statements or other information submitted by users is the sole responsibility of the submitting user. User generated content is provided for entertainment purposes only, and you should in no way rely on the accuracy, completeness or reliability of any Member Submissions.
You will be solely responsible for the content of your Member Submissions, and you agree to indemnify and hold harmless Vote.Com and its affiliates and agents against any claim or damages arising from your Member Submissions.
Vote.com welcomes and indeed is designed to foster spirited debate. Feel free to be passionate with your opinions, and to disagree with the opinions of others. However, your conduct must always be courteous and respectful, even when in disagreement. Challenges must be restricted to other points of view and opinions; personal attacks and insults are not allowed. Do not use profanity, vulgarity, threatening, offensive or hateful speech; do not harass or "flame" other users.
Do not post commercial messages or solicitations, including links to other internet sites. Do not post duplicate messages. Do not post personal information about yourself, but also do not misrepresent yourself by impersonating another person or entity. Keep your posts and chat "on topic". The use of Vote.com for illegal activity, or advocating illegal activity, is strictly prohibited.
Vote.com does not monitor or review Member Submissions, nor does it have the practical ability to do so. However, Vote.com has the right to delete or modify Member Submissions (without notice) that violate these Terms and Conditions or are otherwise considered objectionable by Vote.com in its sole discretion. If you believe that a Member Submission warrants removal for this reason, please notify us at comments@vote.com. Vote.com does not have any obligation, however, to review Member Submissions, or to delete or modify Member Submissions, even after being notified of a potential violation.
Chat Guidelines
Chat is interactive, real time conversation with other users. Vote.com chats are intended for open discussion and the free exchange of ideas. The rules for Member Conduct listed above apply to participation in chat as well as to other forms of Member Submissions.
Vote.com does not monitor chat activity, nor does it have the practical ability to do so. Although certain scheduled and other chats may be hosted by a Vote.com representative, that does not constitute "monitoring" for purposes of controlling objectionable content or enforcing these Terms and Conditions. However, Vote.com does have the right (without notice) to monitor and review chat activity. If you believe that a users's conduct in chat violates these Terms and Conditions, please notify us at comments@vote.com. Vote.com does not have any obligation, however, to monitor or review chat activity, or taken any action in respect of chat conduct, even after being notified of a potential violation.
Outside Links; Third Party Purchases
Vote.com is not responsible for the content of any sites that may be linked to the Vote.com site, and use of these linked sites is at your sole risk. These other sites may have privacy policies that are different from the Vote.com privacy policy.
From time to time Vote.com may provide links to or furnish information concerning offers made by third parties for the sale of goods or services. All matters concerning any such purchase (including the accuracy of the product description, payment and delivery terms, warranties, etc.) are strictly between you and the third party. Vote.com is not a party to any such transaction, and makes no representations or warranties concerning the product or services offered, even if Vote.com receives some form of payment in connection with the transaction.
Registration and Password
Although Vote.com does not currently use a password and member registration process, it may implement such a process in the future. In such case, you will be responsible for maintaining the confidentiality of your user name and password. You will be responsible for all uses of your account, whether or not authorized by you. You should immediately notify Vote.com of any unauthorized use of your member name or password.
Termination of Service/Membership
Vote.com reserves the right to deny you access to the Vote.com site at any time and for any reason, including if Vote.com in its sole discretion believes that you have violated these Terms and Conditions or otherwise engaged in unacceptable conduct. In the event that Vote.com institutes a member registration process, Vote.com similarly reserves the right to terminate your membership in Vote.com.
Vote.com reserves the right to change, suspend or discontune all or any aspect of its site at any time, including the availability of any feature, database or content, without prior notice.
Vote.com is a free site. However, Vote.com reserves the right at any time upon prior notice to impose user fees or otherwise charge for access to its site.

Limitation of liability
NEITHER VOTE.COM NOR ITS AFFILIATES OR AGENTS WILL BE RESPONSIBLE FOR OR HAVE ANY LIABILITY FOR ANY LOSS, DAMAGE (INCLUDING, BUT NOT LIMITED TO, ACTUAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES), INJURY OR OTHER CLAIM RELATING TO YOUR USE OF THIS SITE, ANY INFORMATION POSTED ON THIS SITE (INCLUDING THE RESULTS SHOWN ON THIS SITE) WHETHER PROVIDED BY VOTE.COM OR A MEMBER SUBMISSION, YOUR INABILITY TO ACCESS THIS SITE (OR THE NON-FUNCTIONING OF THIS SITE), OR FOR ANY REASON WHATSOEVER, INCLUDING TO THE EXTENT RESULTING FROM THE NEGLIGENCE OF VOTE.COM, ITS AFFILIATES OR AGENTS, EVEN IF VOTE.COM HAS BEEN APPRISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY IN RESPECT OF YOUR USE OF THE VOTE.COM SITE AND ANY INFORMATION OR RESULTS CONTAINED ON THE SITE SHALL BE TO DISCONTINUE USING VOTE.COM.
Indemnification
You agree to indemnify and hold Vote.com, its affiliates and agents, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your use of Vote.com (including the information or results presented by Vote.com), the violation of these Terms and Conditions by you, or any other user of your account, or the infringement by you, or any other user of your account, of any intellectual property or other right of any person or entity.
Miscellaneous
These Terms and Conditions constitute the agreement between you and Vote.com for your use of the Vote.com site and the information on the Vote.com site (the "Agreement"). This Agreement is governed by and construed in accordance with the internal laws of the State of New York, and any action brought in connection with this Agreement shall be brought in the state or Federal courts sitting in the State of New York unless Vote.com shall at its sole option elect to bring an action elsewhere. You hereby submit to the jurisdiction of such courts for the purposes of any claim brought in connection herewith.
This Agreement contains the entire agreement between you and Vote.com. If any provision of this Agreement shall be unlawful, void or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions, and this Agreement shall be construed so as to give effect to the fullest extent possible to the stricken provision.
These Terms and Conditions shall survive any termination of your membership account, if any.
